What is Company
Company is not a dental group or a healthcare provider. Company provides its users with the ability to obtain access to dental services provided by independent United States-based dental providers.
A Note about Protected Health Information
If you use Company’s services because they are offered to you from one of our affiliated professional entities that provides dental services you, we may collect Protected Health Information about you that is governed by HIPAA, either directly from you or from or on behalf of our affiliated professional entity. Where this is the case, we act as a “business associate” to the affiliated professional entity, and your health plan’s or our affiliated professional entity’s Notice of Privacy Practices and our agreements with your health plan or our affiliated professional entity will govern the use of your Protected Health Information, not this Privacy Policy. This Privacy Policy applies to all Personal Information of California Consumers that we collect both online and offline, including through California Consumers’ (a) visits to our www.byte.com website (“Website”) or byteme mobile application (“Mobile App”), and (b) use of our services and products that references this Privacy Policy (collectively, the “Services”).

For purposes of this Privacy Policy, “Consumer” does not include:

Byte does not share, sell, or otherwise disclose your Personal Data for purposes other than those outlined in this CA Notice. We disclose your Personal Data to a few third parties, including: your licensed dental provider, Byte’s affiliated dental providers/professionals, Byte’s subsidiaries and affiliates, third-party service providers, subcontractors, and business associates we use to support our business, to the extent of a merger or acquisition, to the new owner(s) of the company or any company purchased by, or merged with Byte, those agencies to which we are required to disclose by law or to comply with legal obligations, companies hired or used to enforce our legal rights, to parties with whom you have provided your express consent. We may also share information to comply with any court order, law, or legal process, including to respond to any government or regulatory request, to enforce our Terms of Use or the Mobile App’s End User License Agreement, for billing and collection purposes, and if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of you, your licensed provider and/or her/his staff, Byte, Straight Smile, LLC, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
3. Your California Privacy Rights
a) Right to Know
California Consumers have the right to submit a verifiable request to know:
The categories and specific pieces of Personal Information that Company has collected about them;
The categories of sources from which Company collected the Personal Information;
The categories of Personal Information that Company sold or disclosed to a third party (other than a service provider) for a business purpose and the categories of recipients of that information; and
The business or commercial purposes for Company’s collection, disclosure, or sale of the Personal Information.
b) Right To Delete
California Consumers have the right to submit a verifiable request for deletion of their Personal Information that Company has collected from the Consumer.
c) Right to Opt Out of Sale of Personal Information
California Consumers have a right to opt-out of the sale of the Personal Information. However, as stated above, Company does not and will not sell Personal Information.
4. How To Exercise Your Rights
Company will respond to requests in accordance with applicable law if it can verify the identity of the individual submitting the request. California Consumers can exercise their rights by emailing us at privacy@byteme.com. Please describe your request (e.g., right to know or right to delete) with sufficient detail that allows us to properly understand, evaluate, and respond to it.
Requests By Authorized Agents
You can have an authorized agent submit a CCPA request to us on your behalf by (a) providing us with a written authorization signed by you that designates the agent as your authorized agent for purposes of a CCPA request; (b) verifying your identity directly with us; and (c) directly confirming with us that the agent is authorized to submit the request.
How We Will Verify Your Requests
To prevent anyone other than you, or your authorized agent, from exercising the right to know or the right to delete with respect to your personal information, we follow procedures to verify your, or your agent’s, identity. This process seeks to confirm that the person making a request is the person about whom we have collected personal information or that person’s authorized agent. The verification process involves matching data points that you provide with your request against information about you we already have in our records and that we have determined to be reliable for purposes of verifying your identity. We will use information you provide in your completed request to verify your identity, and we may request additional information if necessary to complete the verification process. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

The Company’s Non-Discrimination Policy
California Consumers have the right not to be subject to discriminatory treatment by Company for exercising their privacy rights under the California Consumer Privacy Act, and Company will not discriminate on that basis. However, Company may charge a California Consumer a different price or rate or provide a different level or quality of goods or services if the difference is reasonably related to the value provided to the California Consumer by the Consumer’s Personal Information.
